Notice: This document is based on Evolutio’s Terms of Use (Clients and Professionals) and on Quebec Law 25 and PIPEDA. It is not legal advice. Have it reviewed by a lawyer before you publish it.
This Policy explains how Application mobile Evolutio inc. (“Evolutio”, “we”) collects, uses, discloses and protects personal information when you use the Evolutio application, the website evolutioapp.com and related services (together, the “Services”).
It supplements the Terms of Use for Clients and the Terms of Use for Professionals. If there is a conflict on a personal-information point, this Policy and applicable law prevail.
1.1
The organization responsible for personal information relating to the operation of the platform is:

1.2
Evolutio’s role. Evolutio provides a technology platform. Professional Services (consultations, treatments, programs, advice) are provided only by the Professional. Evolutio is not a healthcare professional and does not give medical advice.
For the Professional’s account (subscription, subscription billing, identifiers): Evolutio processes this information to operate the Service.
For the Client’s files, messages, exercises, appointments and documents: Evolutio stores them to provide the Services and to allow the Professional you consult to perform the requested Professional Services, as contemplated by the consent in the Terms of Use.
This policy applies to:
Clients (users of the client app), 18 years of age or older and, under the Terms of Use, residents of Quebec;
Professionals (physiotherapists, osteopaths, kinesiologists, rehabilitation technicians, personal trainers and other musculoskeletal professionals, expressly excluding physicians);
Website visitors and people who write to us.
The Services are not directed to anyone under 18.
3.1
Information you provide:
Identity and contact details: name, email, phone, account identifiers, password (stored securely).
Professional profile: profession, practice information, representations as to licence or permit (the Professional is responsible; Evolutio does not verify credentials).
Health and follow-up information entered in the App: history, notes, questionnaires, uploaded documents, photos or files, programs and exercises, appointment history, messages, consents.
Transactional information: Market Place purchases (programs, sessions, the Professional’s products), receipt generation. Payment for Professional Services is generally made to the Professional; the Professional’s subscription is charged to the card provided at sign-up.
Communications with Evolutio: emails to info@evolutioapp.com, support requests.
3.2
Information collected automatically:
Technical usage data for the App and website (device, login logs, diagnostics needed to keep the Service working).
Notifications required to deliver the Service (appointment reminders, messages).
3.2
Accuracy:
The Terms of Use require you to provide information that is accurate, truthful and only as complete as needed for the Services or Professional Services. Evolutio does not decide which health information should be shared; you (Client or Professional) enter it.
As set out in section 8 of the Terms of Use, Evolutio collects, processes and stores personal information only to:
create and secure your account and identifiers;
provide the Services: booking, consultations or sessions through the App, messaging, exercise library, notifications, receipts, Market Place, statistics for the Professional;
disclose your information to the Professional you consult so they can perform the Professional Services you requested;
allow the Professional to view, through the App, information (including medical information) you disclosed;
allow Professionals, where the Client Terms provide for it, to share information with one another (for example history) strictly to improve time and quality of Professional Services;
bill the Professional’s subscription and administer the account;
notify you of a confidentiality incident when the law requires it;
produce anonymous, aggregated information to improve the Services, analyse use and support business intelligence — with no name or identifiable personal information;
comply with a legal obligation (tax, a competent authority, minimum retention).
We do not use your health information for targeted advertising to 3rd parties.
Processing is based mainly on:
your consent, given by accepting the Terms of Use and this Policy (section 8 of the Terms);
performance of the Services contract (account, calendar, messaging, exercises, receipts, subscription);
a legal obligation, where applicable;
a limited legitimate interest in platform security and anonymous statistics.
You may withdraw consent, except where processing remains necessary to perform the contract or the law. Withdrawal may prevent use of some or all of the Services.
Evolutio restricts access to persons who need it to perform the Services, and to the Professionals you consult.
The Professional you chose, to deliver Professional Services.
Other Professionals, only as contemplated in the Client Terms (quality and continuity of Professional Services).
Service providers that help us operate the platform (hosting, cloud, email or SMS, subscription payment processing, development and technical support), only as needed and under confidentiality commitments.
A public authority, if the law requires it.
Evolutio does not sell personal information.
Professional Services, the Professional’s fees and refunds for Professional Services are the Professional’s responsibility, not Evolutio’s.
Some providers or support activities may involve access or hosting outside Quebec or Canada. In that case, Evolutio aims to frame those transfers by contract (security, confidentiality, purpose limitation), in line with Law 25 and PIPEDA.

We keep information for as long as needed for the purposes above:
active account: while the account or subscription is in force;
end of subscription: the Terms state that data may no longer be available after the account ends. A Professional who has a legal or professional duty to retain Client records must export them before the subscription ends;
subscription billing data: the period required by tax law;
anonymous aggregated data: may be kept without a time limit, because it no longer identifies anyone;
after a deletion request: we delete or anonymize unless law, a dispute or security requires limited retention.
Evolutio does not guarantee recovery of data after termination, as stated in the Terms of Use. That does not prevent you from exercising the rights in section 10 while the account exists and as the law allows.
Evolutio implements commercially reasonable measures to protect the security, confidentiality, integrity, availability and authenticity of personal information, including:
encryption in transit;
access limited to what is needed;
confidential identifiers — you must protect them and notify info@evolutioapp.com if they are lost, stolen or used suspiciously;
prompt notice to affected users of a confidentiality incident, as required by law and the Terms of Use.
No system is risk-free. You are responsible for the security of your device and identifiers.
Subject to exceptions in the law, you may:
be informed that a file exists and of its purposes;
access personal information we hold about you;
have inaccurate or incomplete information corrected;
withdraw consent where processing is based on consent;
request that dissemination stop or that information be de-indexed in the cases provided by Law 25;
complain to us, then to the Commission d’accès à l’information du Québec (CAI) or, where applicable, the Office of the Privacy Commissioner of Canada.
To exercise a right, write to info@evolutioapp.com. We may ask for proof of identity. If the request concerns a file held for a Professional, we may also direct you to that Professional, who remains responsible for Professional Services and certain professional retention duties.
www.evolutioapp.com may use cookies needed for the site to work and, where applicable, audience-measurement tools. You can control them in your browser. Links to 3rd-party sites (Terms, s. 11) are not covered by this Policy.
We may change this policy. Notice will be given by email to the last known address or in the app, as for the Terms of Use. Continued use of the Services after notice constitutes acceptance of the updated version, subject to rights the law does not allow you to give up.
This Policy is governed by the laws of Quebec and applicable federal laws of Canada, including Law 25 and PIPEDA. The Terms of Use specify the courts that have jurisdiction over the user agreement.
